1. Introducción y aceptación

Estos Términos de Uso ("Términos") explican las reglas que aplican cuando creas una cuenta, accedes o usas AVERION Driver y las herramientas de software relacionadas para conductores (el "Servicio").

AVERION Driver es operado bajo la marca AVERION. La denominación jurídica completa del operador, su domicilio y demás datos societarios se publicarán aquí cuando estén definidos; no se muestran datos corporativos inventados.

Al crear una cuenta, acceder o usar el Servicio, confirmas que has leído, entendido y aceptas estos Términos y la Política de Privacidad presentada junto con ellos. Si no estás de acuerdo, no crees una cuenta y no uses el Servicio.

Si usas el Servicio en nombre de otra persona o entidad, declaras que tienes autoridad para vincularla a estos Términos.

2. Elegibilidad

Para crear y mantener una cuenta de conductor debes tener capacidad legal para celebrar un contrato vinculante y cumplir la edad mínima exigida por la ley aplicable para este tipo de actividad independiente.

AVERION Driver permite el registro de conductores en Estados Unidos. El alta e inicio de sesión actuales usan un número de teléfono móvil de Estados Unidos (+1) verificado con un código de un solo uso por SMS (OTP). El registro está disponible en los 50 estados de Estados Unidos y en Washington, D.C. No ofrece actualmente registro en otros países.

La disponibilidad de determinadas funciones puede depender de requisitos legales, técnicos, de suscripción y de elegibilidad de la cuenta.

Eres el único responsable de confirmar que puedes operar legalmente como conductor independiente en los lugares donde elijas trabajar, incluidas las licencias, permisos, seguros y requisitos del vehículo que te apliquen.

El registro nacional no garantiza demanda, reservas, clientes ni que todos los servicios estén disponibles en todas las ubicaciones. La disponibilidad de AVERION Driver no implica, por sí sola, que toda forma de transporte de pasajeros remunerado esté autorizada donde trabajas.

3. Cuenta del conductor

Para usar la mayoría de las funciones debes registrar una cuenta de conductor. El registro actual verifica un número de teléfono móvil de Estados Unidos (+1) con un código de un solo uso por SMS. Tras la verificación completas datos de perfil como tu nombre y correo, y aceptas las versiones vigentes de consentimiento legal. Más adelante puedes añadir ciudad, estado, ZIP y un área habitual de servicio en tu perfil; esos campos son informativos y no controlan el registro ni bloquean el acceso al Servicio.

AVERION Driver no ofrece actualmente Apple Sign-In, Google Sign-In ni correo y contraseña como método de alta. El correo se recopila como dato de contacto de la cuenta después de verificar el teléfono; no es el método principal de inicio de sesión en esta versión.

Aceptas que la información que envías es exacta, completa y actual, y que eres responsable de mantenerla así conforme cambie.

Eres responsable de la confidencialidad de tus códigos SMS, del acceso a tu dispositivo y de la actividad que ocurra bajo tu cuenta. Notifícanos por los canales de soporte disponibles si sospechas acceso no autorizado.

Podemos rechazar, limitar o cerrar cuentas cuando sea razonablemente necesario por seguridad, prevención de fraude, cumplimiento legal o aplicación de estos Términos.

4. Información del perfil

Además del registro, la app puede pedirte completar campos adicionales de perfil. Según las pantallas habilitadas para tu cuenta, esto puede incluir tu fecha de nacimiento, una foto de perfil, los idiomas que hablas, ciudad, estado, ZIP y un área habitual de servicio en cualquier lugar de Estados Unidos, tus años de experiencia como conductor, información de tu vehículo y la aceptación de los documentos legales que se te presenten.

La ciudad, el estado, el ZIP y el área habitual de servicio son informativos y editables. Puedes configurarlos más adelante en tu perfil. No controlan el registro ni bloquean el acceso al Servicio. Otros campos pueden seguir siendo necesarios para personalizar tu perfil o completar pasos de onboarding mostrados en la app.

Eres responsable de la exactitud de cada campo de perfil que envíes o actualices. Proporcionar información opcional de perfil no significa que AVERION certifique tu estatus profesional.

5. Naturaleza de AVERION Driver

AVERION Driver es una aplicación de software. AVERION proporciona la plataforma tecnológica y la infraestructura asociada; no es tu empleador, no es propietario de tu vehículo, no es una aseguradora y no es un banco ni custodio del dinero que te pagan tus clientes.

Llamar al Servicio "software" no exime por sí solo de toda responsabilidad; las exenciones y limitaciones de estos Términos aplican solo en la medida permitida por la ley.

AVERION Driver proporciona herramientas digitales para que conductores independientes administren sus propios servicios y clientes privados. Cada conductor es responsable de mantener las licencias, seguros y permisos exigidos en los lugares donde presta sus servicios.

Para acceder a la cuenta, AVERION puede recopilar y revisar en su panel Admin la información y documentos que envías en el registro (por ejemplo foto de perfil, licencia de conducir, datos del vehículo, seguro y área de servicio). Un revisor humano puede aprobar cada elemento, solicitar una corrección o rechazar la solicitud. Esa revisión es un control interno de la plataforma para activar el software; no constituye una verificación oficial de antecedentes, ni una certificación o licencia gubernamental, y AVERION no garantiza el cumplimiento legal de tus operaciones fuera de la app.

La clasificación comercial y legal de la relación entre tú, AVERION y tus clientes puede depender de la jurisdicción donde operes y de las funciones concretas que uses; esa clasificación sigue sujeta a revisión por asesoría legal conforme evolucionen el producto y sus mercados.

6. Clientes y servicios

AVERION Driver es software para clientes privados: tú gestionas tus propios clientes y los servicios que les prestas. En esta versión del Servicio no existe un mercado público de pasajeros ni asignación automática de viajes.

Puedes agregar clientes con los que ya trabajas para organizar sus datos de contacto e historial de reservas. Eres responsable de contar con el permiso necesario para almacenar esa información.

AVERION no se convierte en parte de tu relación con un cliente, y no selecciona, asigna ni garantiza clientes para ti.

7. Reservas

Cuando las herramientas de reservas estén habilitadas para tu cuenta, puedes crear, ver y gestionar reservas para tus propios clientes — por ejemplo, datos de origen y destino, fecha y hora programada y notas relacionadas.

Las herramientas de reservas te ayudan a organizar tus propias reservas privadas; no crean una promesa de disponibilidad continua de trabajo, clientes ni un horario fijo.

La disponibilidad de funciones puede cambiar conforme evolucione el producto. Algunas herramientas de reservas pueden no estar aún habilitadas para todas las cuentas, según requisitos legales, técnicos, de suscripción y de elegibilidad de la cuenta.

8. Ofertas

Cuando estás marcado como disponible y has activado la opción de recibir ofertas, las solicitudes vinculadas a tus reservas o clientes pueden aparecer en tu pantalla de Inicio como ofertas para que las revises.

Que una oferta aparezca en tu pantalla es solo una notificación; no te compromete a nada hasta que actúes sobre ella.

Activar la disponibilidad o la opción de recibir ofertas no crea una relación laboral ni garantiza que se presente ninguna oferta.

9. Aceptación y rechazo de ofertas

Cada oferta requiere una acción explícita de tu parte: "Aceptar oferta" o "Rechazar". Recibir una oferta nunca la acepta automáticamente, y el Servicio no acepta ofertas en tu nombre.

Si una oferta expira antes de que actúes, ya no puedes aceptar esa oferta específica como vigente; puede ser necesario volver a crear o reenviar la solicitud subyacente.

Patrones abusivos y repetidos de aceptación o rechazo que perjudiquen la integridad del Servicio pueden dar lugar a revisión y a la posible restricción de las herramientas relacionadas.

10. Tarifas y estimaciones

El Servicio incluye una calculadora de tarifas que produce una estimación basada en las tarifas y parámetros que configures y en los datos del viaje que ingreses. Una estimación es una ayuda de cálculo, no un precio final garantizado.

El precio final que le cobras a un cliente es una cifra distinta que fijas o confirmas para ese servicio en concreto, y puede diferir de la estimación inicial por razones como cambios de ruta, tiempo de espera, peajes o tus propias decisiones comerciales.

El importe que después registras como ganancia registrada (ver el siguiente apartado) es una cifra informativa que introduces o confirmas después del hecho; no es automáticamente idéntico a la estimación ni al precio final, salvo que tú lo hagas coincidir.

11. Ganancias registradas

Las herramientas de Ganancias te permiten llevar un registro informativo de los importes que declaras haber recibido — por ejemplo, la parte de la tarifa y cualquier propina — por un servicio completado o introducido manualmente. Este registro es solo informativo: no es un saldo bancario, no es dinero en custodia de AVERION y no es un sistema de pagos.

Una ganancia registrada puede originarse en una reserva completada o introducirse manualmente por ti con un importe, una fecha y notas opcionales. Cuando esas herramientas estén habilitadas para tu cuenta, puedes crear, ver, editar o eliminar una ganancia registrada.

Cada ganancia registrada guarda la marca de tiempo en que se ganó o registró, de forma que tu historial refleje cuándo se hicieron las entradas o cuándo ocurrió el servicio subyacente.

Tus clientes te pagan directamente por los servicios que les prestas. AVERION no procesa, retiene ni garantiza esos pagos a través de este registro.

12. Suscripción AVERION Driver

Determinadas herramientas comerciales de AVERION Driver requieren una suscripción AVERION Driver activa. Las condiciones comerciales completas de esa suscripción — precio, ciclo de facturación, métodos de pago, reembolsos y mecánicas relacionadas — se describen en el documento independiente de Suscripción y Facturación, que debes leer junto con estos Términos.

La arquitectura de suscripción incluye un período de prueba gratuita. En la configuración actual del producto, la duración es de 7 días. No requiere tarjeta ni genera cobros automáticos, y comienza cuando el conductor la inicia en la app.

Al terminar, las herramientas de trabajo requieren una suscripción de USD 29.99 al mes (el importe final en App Store se confirma en la app). El perfil, historial y Soporte permanecen accesibles.

13. Prueba gratuita

Los conductores aprobados pueden activar una prueba gratuita de 7 días. No requiere tarjeta ni genera cobros automáticos. La prueba comienza cuando el conductor pulsa «Iniciar prueba gratuita» en la app, no al crear la cuenta.

Al terminar, las herramientas de trabajo requieren una suscripción de USD 29.99 al mes. El perfil, historial y Soporte permanecen accesibles.

La prueba se ofrece una sola vez por conductor elegible y no se renueva automáticamente.

14. Renovación y facturación

Una vez que una suscripción de pago está activa y el proveedor de facturación lo permite, la renovación suele ser automática al final de cada período de facturación, salvo que la canceles antes.

Los métodos de pago aceptados son los del proveedor de facturación oficial conectado (por ejemplo, una tienda de aplicaciones u otro canal oficial una vez conectado). No uses canales de pago no oficiales — como transferencias bancarias, apps de pago entre particulares, criptomonedas, tarjetas de regalo o efectivo — para intentar activar o renovar una suscripción.

Si un pago falla, tu suscripción puede pasar a un estado de pago pendiente y, si el producto configura uno, a un período de gracia, antes de pasar a restringida o vencida. Un pago fallido no elimina por sí solo tu cuenta ni tus registros de aceptación legal.

15. Cancelación

Puedes cancelar la renovación de tu suscripción AVERION Driver desde la pantalla de gestión de suscripción en la app o desde tu proveedor de facturación.

Cancelar tu suscripción no es lo mismo que eliminar tu cuenta. Cancelar solo detiene renovaciones futuras y, según tu plan, las herramientas comerciales asociadas a él.

Si ya pagaste el período actual y el proveedor de facturación lo permite, conservas el acceso a las herramientas de pago hasta el final de ese período; la app muestra la fecha de fin cuando esté disponible. Después de esa fecha, las herramientas comerciales pueden restringirse.

16. Funciones restringidas por falta de suscripción

Cuando tu cuenta no tiene un entitlement comercial activo — por ejemplo, en un estado restringido, vencido o con pago pendiente sin período de gracia — la app restringe herramientas comerciales como recibir nuevas ofertas, crear o gestionar reservas, usar la gestión de clientes, las herramientas de tarifas y las herramientas de ganancias.

Independientemente del estado de la suscripción, siempre conservas acceso a: el Centro Legal y sus documentos, soporte al cliente cuando esté disponible, seguridad de la cuenta, gestión o reactivación de la suscripción, y el flujo de eliminación de cuenta.

Si ya tienes un viaje o una reserva activa en curso cuando tu entitlement caduca, puedes finalizar ese servicio concreto; la restricción aplica a iniciar nueva actividad comercial, no a abandonar trabajo que ya está en curso.

17. Uso permitido

Puedes usar el Servicio solo con fines lícitos compatibles con estos Términos y solo mediante las interfaces y credenciales proporcionadas para tu cuenta.

Puedes usar las herramientas operativas disponibles para gestionar tu actividad como conductor independiente y tus propios clientes privados. El registro nacional no garantiza demanda, reservas ni disponibilidad de clientes.

Debes seguir prácticas razonables de seguridad e integridad y respetar los derechos de tus clientes y de otros usuarios.

18. Conducta prohibida

Aceptas no hacer un uso indebido del Servicio. Sin limitación, no debes: acceder a cuentas o datos sin autorización; interferir con la seguridad o disponibilidad; introducir malware; extraer o automatizar el acceso de forma abusiva; hacer ingeniería inversa salvo donde la ley lo prohíba restringir; acosar o dañar a otros; ni usar el Servicio para vulnerar la ley aplicable.

No debes usar el Servicio para facilitar transporte ilegal, fraude, blanqueo de capitales, robo de identidad u otra actividad ilícita, ni falsear tu identidad o la naturaleza de los servicios que ofreces.

Está prohibido manipular reservas, ofertas, disponibilidad, promociones u otras señales del producto de forma engañosa, o crear múltiples cuentas para evadir restricciones; puede dar lugar a suspensión o cierre.

19. Seguridad

No debes intentar sondear, escanear o probar la vulnerabilidad del Servicio salvo con autorización previa por escrito, ni eludir protecciones técnicas, límites de uso o controles de acceso.

Protege tu dispositivo, no compartas tus códigos SMS ni el acceso a tu cuenta de AVERION, y no permitas que otras personas la usen. Notifícanos sin demora por los canales de soporte disponibles si sospechas acceso no autorizado a tu cuenta.

AVERION puede adoptar medidas de protección — incluidos bloqueos temporales, verificación adicional o límites de funciones — cuando razonablemente detectemos riesgos de seguridad o fraude.

20. Ubicación

Determinadas funciones solicitan acceso a la ubicación de tu dispositivo. Cuando te pones en línea para aceptar reservas, la app solicita permiso de ubicación en primer plano ("mientras se usa la app") y usa el GPS para registrar tu posición aproximada mientras permaneces en línea, de modo que las herramientas que dependen de la ubicación puedan funcionar.

Estos Términos no afirman que AVERION mantenga un rastreo permanente en segundo plano de tu dispositivo. El tratamiento de ubicación está ligado a las funciones que la necesitan y al modelo de permisos de tu sistema operativo.

Puedes denegar o revocar el permiso de ubicación en los ajustes de tu dispositivo en cualquier momento; hacerlo puede desactivar funciones que dependan de él, como ponerte en línea para reservas o herramientas relacionadas con mapas.

21. Contactos de emergencia

El Centro de Seguridad te permite guardar contactos de emergencia — un nombre y un número de teléfono — directamente en tu dispositivo, para tenerlos a mano dentro de la app.

Si usas el selector de contactos, la app solicita el permiso de Contactos de tu dispositivo solo para ayudarte a elegir una entrada; no se usa para importar toda tu libreta de contactos a AVERION.

La compartición de ubicación en vivo con un contacto de emergencia durante un viaje no está actualmente conectada de extremo a extremo. Estos Términos no afirman que AVERION comparta tu ubicación en vivo con tus contactos de emergencia; si esa función se activa más adelante, este documento y los avisos en la app se actualizarán primero.

22. Mensajería y soporte

La bandeja de mensajería dentro de la app está diseñada para mostrar conversaciones con clientes, soporte y la plataforma. En la versión actual, el backend de mensajería aún no almacena ni sincroniza el historial de mensajes; no debes depender de la app para conservar un registro permanente en la nube de tus conversaciones.

Los casos de soporte que abres se almacenan actualmente de forma local para que puedas seguirlos dentro de la app. Cuando exista un backend de soporte conectado, los casos podrán escalarse a un especialista humano para su revisión.

No dependas de la mensajería dentro de la app para asuntos de seguridad urgentes; contacta directamente a los servicios de emergencia locales cuando corresponda.

23. Asistente AVERION

El Asistente AVERION es una herramienta de ayuda local basada en reglas que responde preguntas frecuentes sobre el uso de AVERION Driver mediante respuestas predefinidas por tema. No está conectado a un servicio remoto de inteligencia artificial y no lee ni expone tus datos privados de cuenta más allá de lo que escribes en el chat.

El Asistente AVERION no es un servicio de emergencia y no ofrece asesoramiento legal, médico ni financiero. No dependas de él en situaciones de seguridad urgentes — contacta a los servicios de emergencia locales en su lugar.

Cuando una pregunta está fuera de lo que el Asistente puede responder, o pides hablar con una persona, te ofrece escalar tu caso a Soporte AVERION para que un especialista lo revise.

24. Privacidad

El tratamiento que hacemos de tu información personal en relación con el Servicio se describe en la Política de Privacidad, que forma parte de tu acuerdo con nosotros junto con estos Términos.

Al usar el Servicio, reconoces las prácticas descritas en la Política de Privacidad, incluidos qué datos se recopilan actualmente y qué funciones descritas siguen siendo futuras o aún no están habilitadas.

25. Propiedad intelectual

El Servicio — incluidos su software, marca, logotipos, diseño, textos y materiales relacionados — es propiedad de AVERION o de sus licenciantes y está protegido por la legislación de propiedad intelectual.

Estos Términos te otorgan un derecho limitado, no exclusivo, intransferible y revocable a usar el Servicio únicamente según lo permitido para tu cuenta.

Conservas derechos sobre el contenido que envías (por ejemplo, notas de clientes o texto de perfil que introduzcas), sujeto a las licencias que AVERION necesita para alojar, procesar, respaldar y mostrarte ese contenido como parte de operar el Servicio.

26. Disponibilidad del servicio

Procuramos mantener el Servicio disponible y útil, pero no garantizamos un funcionamiento ininterrumpido, oportuno o libre de errores. El mantenimiento, las interrupciones, problemas de red, limitaciones del dispositivo e incidentes de proveedores externos pueden afectar el acceso.

Las funciones pueden añadirse, modificarse, limitarse o discontinuarse conforme evolucione el producto. La disponibilidad de determinadas funciones puede depender de requisitos legales, técnicos, de suscripción, de elegibilidad de la cuenta y de la versión del producto.

AVERION no garantiza un número mínimo de solicitudes, reservas, clientes, viajes ni un nivel de ingresos determinado; la demanda y los resultados varían según el mercado, el momento, tus propias decisiones y factores fuera de nuestro control.

27. Suspensión y terminación

Podemos suspender, restringir o cerrar el acceso a parte o a la totalidad del Servicio si razonablemente consideramos que incumpliste estos Términos, generas un riesgo de seguridad o fraude, no cumples requisitos de elegibilidad, creas riesgo legal u operativo, o si lo exige la ley.

Cuando sea práctico y esté legalmente permitido, daremos aviso de restricciones significativas.

La suspensión o el cierre no eliminan obligaciones que por su naturaleza deban sobrevivir, como obligaciones ligadas a un período de suscripción ya facturado, o disposiciones de responsabilidad en la medida permitida por la ley.

28. Eliminación de cuenta

Puedes dejar de usar el Servicio en cualquier momento y solicitar la eliminación de tu cuenta mediante el flujo disponible en Perfil / Configuración. Cancelar una suscripción es una acción distinta de eliminar tu cuenta — cancelar no elimina tu cuenta por sí sola.

Tras la confirmación explícita y la autenticación reciente, el servicio seguro de eliminación borra tu usuario de Authentication y los datos de cuenta asociados según la Política de Privacidad. Algunos registros anonimizados pueden conservarse cuando lo exija la ley o la prevención de fraude.

Incluso con una suscripción restringida, siempre puedes acceder a los documentos legales y al flujo de eliminación de cuenta.

29. Cambios a los Términos

Podemos modificar estos Términos. Cuando lo hagamos, actualizaremos la versión y la fecha de entrada en vigor mostradas en la app y pondremos los Términos actualizados a disposición antes de que entren en vigor.

Si los cambios son materiales, podemos exigir una nueva aceptación cuando la ley lo requiera o cuando lo elijamos por claridad.

El uso continuado del Servicio tras la fecha efectiva de los Términos actualizados implica aceptación, salvo cuando la ley exija un consentimiento adicional.

1. Introduction and acceptance

These Terms of Use ("Terms") explain the rules that apply when you create an account, access, or use AVERION Driver and the related driver software tools (the "Service").

AVERION Driver is operated under the AVERION brand. The operator’s full legal name, registered address, and other corporate details will be published here when defined; invented corporate details are not shown.

By creating an account, accessing, or using the Service you confirm that you have read, understood, and agree to these Terms and to the Privacy Policy presented together with them. If you do not agree, do not create an account and do not use the Service.

If you use the Service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

2. Eligibility

To create and keep a driver account you must have legal capacity to enter into a binding agreement and meet any minimum age required by applicable law for this type of independent activity.

AVERION Driver allows driver registration in the United States. Current signup and sign-in use a United States (+1) mobile phone number verified with a one-time SMS code (OTP). Registration is available in all 50 U.S. states and Washington, D.C. It does not currently offer registration in other countries.

The availability of certain features may depend on legal, technical, subscription, and account-eligibility requirements.

You are solely responsible for confirming that you may lawfully operate as an independent driver in the places where you choose to work, including any licenses, permits, insurance, and vehicle requirements that apply to you.

National registration does not guarantee demand, bookings, clients, or that every service is available in every location. Availability of AVERION Driver does not, by itself, mean that every form of paid passenger transport is authorized where you work.

3. Driver account

To use most features you must register a driver account. Current registration verifies a United States (+1) mobile phone number with a one-time SMS code. After verification you complete profile details such as your name and email, and accept the current legal consent versions. You may later add city, state, ZIP, and a habitual service area in your profile; those fields are informational and do not control registration or block access to the Service.

AVERION Driver does not currently offer Apple Sign-In, Google Sign-In, or email-and-password as the signup method. Email is collected as an account contact after phone verification; it is not the primary login method in this version.

You agree that the information you submit is accurate, complete, and current, and that you are responsible for keeping it that way as it changes.

You are responsible for the confidentiality of your SMS codes, your device access, and activity that occurs under your account. Notify us through available support channels if you suspect unauthorized access.

We may refuse, limit, or close accounts when reasonably necessary for security, fraud prevention, legal compliance, or enforcement of these Terms.

4. Profile information

Beyond signup, the app may ask you to complete additional profile fields. Depending on the screens enabled for your account, this can include your date of birth, a profile photo, the languages you speak, city, state, ZIP, and a habitual service area anywhere in the United States, your years of driving experience, vehicle information, and acceptance of the legal documents presented to you.

City, state, ZIP, and habitual service area are informational and editable. You may set them later in your profile. They do not control registration and do not block access to the Service. Some other fields may still be needed to personalize your profile or complete onboarding steps shown in the app.

You are responsible for the accuracy of every profile field you submit or update. Providing optional profile information does not mean AVERION certifies your professional status.

5. Nature of AVERION Driver

AVERION Driver is a software application. AVERION provides the technology platform and related backend infrastructure; it is not your employer, is not the owner of your vehicle, is not an insurer, and is not a bank or custodian of the money your clients pay you.

Calling the Service "software" does not by itself waive all liability; disclaimers and limitations in these Terms apply only to the extent permitted by applicable law, as described in the disclaimers and limitations that would accompany a fuller legal review of this document.

AVERION Driver provides digital tools for independent drivers to manage their own services and private clients. Each driver is responsible for maintaining the licenses, insurance, and permits required wherever they provide their services.

To access an account, AVERION may collect and review in its Admin panel the information and documents you submit during registration (for example a profile photo, driver’s license, vehicle details, insurance, and service area). A human reviewer may approve each item, request a correction, or reject the application. That review is an internal platform control to activate the software; it is not an official background check, government certification, or license, and AVERION does not guarantee the legal compliance of your operations outside the app.

The commercial and legal classification of the relationship between you, AVERION, and your clients may depend on the jurisdiction where you operate and on the specific features you use; that classification remains subject to review by legal counsel as the product and its markets evolve.

6. Clients and services

AVERION Driver is private-client software: you manage your own clients and the services you provide to them. There is no public passenger marketplace or automatic trip matching in this version of the Service.

You may add clients you already work with so that you can organize contact details and booking history for them. You are responsible for having any permission needed to store that information.

AVERION does not become a party to your engagement with a client, and does not select, assign, or guarantee clients for you.

7. Reservations

When reservation tools are enabled for your account, you can create, view, and manage bookings for your own clients — for example pickup and destination details, scheduled date and time, and related notes.

Reservation tools help you organize your own private bookings; they do not create a promise of continuous availability of work, clients, or a fixed schedule.

Feature availability may change as the product evolves. Some reservation tools may not yet be enabled for every account, depending on legal, technical, subscription, and account-eligibility requirements.

8. Offers

When you are marked available and have opted in to receive offers, requests linked to your bookings or clients can appear on your Home screen as offers for you to review.

An offer appearing on your screen is only a notification; it does not commit you to anything until you act on it.

Toggling availability or the option to receive offers does not create an employment relationship and does not guarantee that any offer will be presented.

9. Acceptance and rejection of offers

Every offer requires an explicit action from you: "Accept offer" or "Reject." Receiving an offer never accepts it automatically, and the Service does not accept offers on your behalf.

If an offer expires before you act on it, you can no longer accept that specific offer as a current one; the underlying request may need to be recreated or re-sent.

Repeated abusive acceptance or rejection patterns that harm the integrity of the Service may lead to review and possible restriction of related tools.

10. Fares and estimates

The Service includes a fare calculator that produces an estimate based on the rates and parameters you configure and the trip details entered. An estimate is a calculation aid, not a guaranteed final price.

The final price you charge a client is a separate figure you set or confirm for that specific service, and may differ from the initial estimate for reasons such as route changes, wait time, tolls, or your own commercial decisions.

The amount you later record as a recorded earning (see the next section) is an informational figure you enter or confirm after the fact; it is not automatically identical to the estimate or to the final price unless you make it so.

11. Recorded earnings

The Earnings tools let you keep an informational ledger of amounts you say you received — for example the fare portion and any tip — for a completed service or entered manually. This ledger is informational only: it is not a bank balance, it is not money held in custody by AVERION, and it is not a payout system.

A recorded earning may originate from a completed booking or be entered manually by you with an amount, a date, and optional notes. When those tools are enabled for your account, you can create, view, edit, or delete a recorded earning.

Each recorded earning stores the timestamp when it was earned or recorded, so your history reflects when entries were made or when the underlying service occurred.

Your clients pay you directly for the services you provide. AVERION does not process, hold, or guarantee those payments through this ledger.

12. AVERION Driver subscription

Certain commercial tools in AVERION Driver require an active AVERION Driver subscription. The full commercial terms of that subscription — pricing, billing cycle, payment methods, refunds, and related mechanics — are described in the separate Subscription & Billing document, which you should read together with these Terms.

The subscription architecture includes a free trial period. In the current product configuration the trial length is 7 days. It does not require a card, does not create automatic charges, and starts when the driver starts it in the app.

When it ends, work tools require a USD 29.99 monthly subscription (the final App Store amount is confirmed in the app). Profile, history, and Support remain accessible.

13. Free trial

Approved drivers can start a 7-day free trial. It does not require a card and does not create automatic charges. The trial begins when the driver taps “Start free trial” in the app, not when the account is created.

When it ends, work tools require a USD 29.99 monthly subscription. Profile, history, and Support remain accessible.

The trial is offered once per eligible driver and does not auto-renew.

14. Renewal and billing

Once a paid subscription is active and the billing provider allows it, renewal is generally automatic at the end of each billing period unless you cancel beforehand.

Accepted payment methods are those of the connected official billing provider (for example an app store or another official channel once connected). Do not use unofficial payment channels — such as bank transfers, peer-to-peer payment apps, cryptocurrency, gift cards, or cash — to try to activate or renew a subscription.

If a payment fails, your subscription may move to a past-due state and, if the product configures one, a grace period, before becoming restricted or expired. A failed payment does not by itself delete your account or your legal acceptance records.

15. Cancellation

You can cancel the renewal of your AVERION Driver subscription from the subscription management screen in the app or from your billing provider.

Canceling your subscription is not the same as deleting your account. Canceling only stops future renewals and, depending on your plan, the commercial tools tied to it.

If you already paid for the current period and the billing provider allows it, you keep access to the paid tools until the end of that period; the app shows the end date when it is available. After that date, commercial tools may be restricted.

16. Features restricted without a subscription

When your account does not have an active commercial entitlement — for example a restricted, expired, or past-due state without a grace period — the app restricts commercial tools such as receiving new offers, creating or managing bookings, using client management, pricing tools, and earnings tools.

Regardless of subscription status, you always keep access to: the Legal Center and its documents, customer support when available, account security, subscription management or reactivation, and the account deletion flow.

If you already have an active trip or booking in progress when your entitlement lapses, you can finish that specific service; the restriction applies to starting new commercial activity, not to abandoning work already underway.

17. Permitted use

You may use the Service only for lawful purposes consistent with these Terms and only through the interfaces and credentials provided for your account.

You may use the operational tools available to you to manage your independent driver activity and your own private clients. National registration does not guarantee demand, bookings, or client availability.

You must follow reasonable security and integrity practices and respect the rights of your clients and other users.

18. Prohibited conduct

You agree not to misuse the Service. Without limitation, you must not: access accounts or data without authorization; interfere with security or availability; introduce malware; scrape or automate access abusively; reverse engineer the Service except where restricted by law; harass or harm others; or use the Service to violate applicable law.

You must not use the Service to facilitate illegal transportation, fraud, money laundering, identity theft, or other unlawful activity, and you must not misrepresent your identity or the nature of the services you offer.

Manipulating bookings, offers, availability, promotions, or other product signals in a deceptive way, or creating multiple accounts to evade restrictions, is prohibited and may lead to suspension or closure.

19. Security

You must not attempt to probe, scan, or test the vulnerability of the Service except with prior written authorization, and you must not circumvent technical protections, rate limits, or access controls.

Protect your device, do not share your SMS codes or access to your AVERION account, and do not allow others to use your account. Notify us promptly through available support channels if you suspect unauthorized access to your account.

AVERION may take protective actions — including temporary blocks, additional verification, or feature limits — when we reasonably detect security or fraud risks.

20. Location

Certain features request access to your device location. When you turn yourself online to accept bookings, the app requests foreground ("when-in-use") location permission and uses GPS to record your approximate position while you remain online, so that location-dependent tools can work.

These Terms do not claim that AVERION maintains permanent background tracking of your device. Location processing is tied to features that need it and to the permission model of your operating system.

You can deny or revoke location permission in your device settings at any time; doing so may disable features that depend on it, such as going online for bookings or map-related tools.

21. Emergency contacts

The Safety Center lets you save emergency contacts — a name and a phone number — directly on your device, so you have them at hand inside the app.

If you use the contacts picker, the app requests your device’s Contacts permission only to help you select an entry; it is not used to import your entire address book into AVERION.

Live location sharing with an emergency contact during a trip is not currently connected end-to-end. These Terms do not claim that AVERION shares your live location with your emergency contacts; if that capability is activated later, this document and the in-app notices will be updated first.

22. Messaging and support

The in-app messaging inbox is designed to show conversations with clients, support, and the platform. In the current build, the messaging backend does not yet store or synchronize message history; you should not rely on the app to keep a permanent cloud record of conversations.

Support cases you open are currently stored locally so you can track them inside the app. When a connected support backend is available, cases may be escalated to a human specialist for review.

Do not rely on in-app messaging for time-sensitive safety matters; contact local emergency services directly when appropriate.

23. AVERION Assistant

AVERION Assistant is a rule-based, on-device help tool that answers common questions about how to use AVERION Driver using pre-written topic replies. It is not connected to a remote AI service, and it does not read or expose your private account data beyond what you type in the chat.

AVERION Assistant is not an emergency service, and it does not provide legal, medical, or financial advice. Do not rely on it in urgent safety situations — contact local emergency services instead.

When a question falls outside what the Assistant can answer, or you ask for a human, it offers to escalate you to AVERION Support so a specialist can review your case.

24. Privacy

Our collection and use of personal information in connection with the Service is described in the Privacy Policy, which forms part of your agreement with us together with these Terms.

By using the Service you acknowledge the practices described in the Privacy Policy, including which data is currently collected and which described features remain future or not yet enabled.

25. Intellectual property

The Service — including its software, branding, logos, design, text, and related materials — is owned by AVERION or its licensors and is protected by intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service solely as permitted for your account.

You retain rights in content you submit (for example client notes or profile text you enter), subject to the licenses AVERION needs to host, process, back up, and display that content to you as part of operating the Service.

26. Service availability

We aim to keep the Service available and useful, but we do not guarantee uninterrupted, timely, or error-free operation. Maintenance, outages, network issues, device limitations, and third-party provider incidents may affect access.

Features may be added, modified, limited, or discontinued as the product evolves. The availability of certain features may depend on legal, technical, subscription, account-eligibility, and product-version requirements.

AVERION does not guarantee a minimum number of requests, bookings, clients, trips, or a particular income level; demand and results vary by market, timing, your own decisions, and factors outside our control.

27. Suspension and termination

We may suspend, restrict, or close access to some or all of the Service if we reasonably believe you violated these Terms, pose a security or fraud risk, fail eligibility requirements, create legal or operational risk, or if required by law.

Where practical and legally permitted, we will provide notice of significant restrictions.

Suspension or closure does not eliminate obligations that by their nature should survive, such as obligations tied to a subscription period already billed, or liability provisions to the extent permitted by law.

28. Account deletion

You may stop using the Service at any time and request deletion of your account through the flow provided in Profile / Settings. Canceling a subscription is a separate action from deleting your account — canceling does not delete your account by itself.

After explicit confirmation and recent authentication, the secure deletion service deletes your Authentication user and associated account data as described in the Privacy Policy. Some anonymized records may be retained when required by law or for fraud prevention.

Even with a restricted subscription, you can always access legal documents and the account deletion flow.

29. Changes to Terms

We may modify these Terms. When we do, we will update the version and effective date shown in the app and make the updated Terms available before they take effect.

If changes are material, we may require renewed acceptance where legally required or where we choose to do so for clarity.

Continued use of the Service after the effective date of updated Terms constitutes acceptance, except where additional consent is required by law.
